Contract for Vendors at the Magickal Minds Metaphysical Fair

This Contract ("Contract") is made and entered into as of the date of submission on this website by and between:

The Interactive Psychic's Magickal Minds Metaphysical Fair ("Event"); The Interactive Psychic ("Organizer")

AND

You ("Vendor") hereby affirm that you are an authorized representative of the Vendor's Business, have the authority to bind this contract on behalf of the Vendor and agree to comply with this Contract.

1. Agreement to Participate

The Vendor agrees to participate in the Magickal Minds Metaphysical Fair organized by The Interactive Psychic. The fair will take place on [Event Date] at [Event Location].

2. Subjective Nature Disclaimer

The Vendor acknowledges that they are engaging in activities that may involve metaphysical practices, readings, therapies, and other holistic services. The Vendor understands that these practices are subjective in nature and that results may vary. The Organizer does not guarantee any specific outcomes or experiences from participation in the fair.

3. Hold Harmless Agreement

The Vendor agrees to hold harmless The Interactive Psychic, Magickal Minds Metaphysical Fair, its organizers, volunteers, and affiliates from any and all claims, liabilities, damages, or expenses arising from their participation in the Magickal Minds Metaphysical Fair. This includes, but is not limited to, any personal injury, property damage, or adverse effects resulting from food, (allergies), products and services provided or received during the event.

4. Permission to Use Information

The Vendor grants The Interactive Psychic/Magickal Minds Metaphysical Fair the right to use their name, business name, images, logos, and any other related content for promotional purposes. This includes, but is not limited to, publication on the fair's website, social media platforms, and other marketing materials. The Vendor understands that this information may be shared publicly and acknowledges that they have the authority to provide such consent.

5. Payment and Fees

The Vendor agrees to pay the specified fee for participation in the Event. Payment is required promptly upon approval of the application. The Organizer will provide details regarding accepted payment methods following application approval. Accepted digital payment options include PayPal and Venmo, among others. Vendors are responsible for ensuring that payment is completed in a timely manner to secure their participation.

6. Compliance with Laws

The Vendor agrees to comply with all local, state, and federal laws and regulations applicable to their business and the services they provide during the event. Vendors must comply with all city and state resale, licensing, and health department regulations. Vendors are responsible for providing their own meals, snacks, and beverages.

7. Vendor Liability

As a vendor, you are responsible for the safe use of all products you offer. If you provide samples or testers, while this is not a requirement, we encourage you to carry liability insurance to cover any claims that may arise. The Magickal Minds Metaphysical Fair and The Interactive Psychic will not be held liable for any complaints or concerns from attendees regarding your products or services. To ensure attendee safety, all samples or testers must display a complete list of ingredients for attendees to review before sampling or utilizing any product or service.

Vendors are liable for any personal injuries, as well as for any lost, stolen, or damaged goods. Additionally, vendors are financially responsible for any damages incurred to the hotel or venue property.

The Magickal Minds Metaphysical Fair and The Interactive Psychic disclaims any responsibility for the safety of vendors, their property, employees, visitors, or customers against theft, loss, injury, or damage due to accidents, fire, or other causes. Vendors assume full liability for any resulting losses. No insurance will be provided for the benefit of vendors or their property. Vendors agree to indemnify and hold the Magickal Minds Metaphysical Fair and The Interactive Psychic and its affiliates harmless from any damages, losses, or liabilities arising from claims, demands, suits, or other actions related to the vendors’ presence in the expo spaces or parking areas during the event.

8. Vendor Presentation

Your presentation, booth setup, and engagement with attendees will significantly impact your success at the event. If you appear distracted by your phone or otherwise disengaged during event hours, you may signal to attendees that you are not available for conversation, leading to missed sales opportunities. Your behavior, presentation, and level of engagement are key to achieving the results you desire. While high-pressure sales tactics are ineffective, a friendly greeting and genuine interest can foster connections. Be present, positive, and ready to engage throughout the day to maximize your potential.

9. Number of Vendor Staff Allowed Per Booth

A maximum of two vendor staff is permitted per booth space, with no exceptions. In a double booth, no more than four vendor staff are allowed. All vendors must be actively engaged in their work, not merely attending or lounging.

10. Day of Event Problems

If you encounter any issues with a neighboring vendor, your booth, or any other matter, please inform Magickal Minds Metaphysical Fair staff on the day of the event so that we can address it together. Delaying until after the show does not benefit anyone.

11. Risk of Loss for Unavoidable Cancellation or Termination

Vendors assume the risk of loss in the event of show cancellation or termination, for which the Organizer bears no responsibility. Should any external factors beyond the Organizer's control (such as acts of God/Universe, civil disobedience, terrorism, war, work stoppages, pandemics, etc.) lead to the cancellation or disruption of the Fair, the Organizer reserves the right to retain payments made by vendors to offset the expenses and losses incurred.

12. Agreement of Terms & Conditions

The vendor acknowledges that they have read, understood, and accepted all terms and conditions.

13. No Refunds

Once the vendor fee has been paid, there will be no refunds issued if the vendor decides to cancel their participation at any time. Vendors who wish to cancel their participation are not permitted to transfer their paid spot to another vendor without prior approval from the organizer in advance of the event.

14. Workshop Facilitators:

By thoroughly reviewing the entire "Workshop" page on this website, you acknowledge that you understand the information presented and agree to conduct yourself and your workshop in a professional manner. You will need to check a box on the application below, granting us permission to reach out to you for a more detailed conversation about your workshop concept. To expedite the process, please have a description of your workshop and/or a graphic prepared for us to obtain when we contact you.

15. Entire Agreement

This Contract constitutes the entire agreement between the parties concerning the subject matter herein and supersedes all prior agreements, understandings, or representations, whether written or oral.

Application Form

Vendor Fee is due within 24 hours of acceptance. Please be proactive in checking your email for your acceptance letter. We work and approve applications quickly.
