Terms and Conditions for Vendors at the Magickal Minds Metaphysical Fair

These Terms and Conditions ("Terms") govern the participation of vendors at The Interactive Psychic's Magickal Minds Metaphysical Fair ("Event"). By applying to be a vendor, you ("Vendor") agree to comply with these Terms, as well as with the directives and decisions made by The Interactive Psychic ("Organizer").

1. Application and Approval

- Vendors must complete and submit the application form along with any required documentation (if requested by MMMF during the application approval process).

- The Organizer reserves the right to approve or deny any application at its sole discretion. Approval will be communicated within 24 to 48 hours after submission.

2. Vendor Fees

- Upon approval, Vendors must pay the designated vendor fee to secure their spot. Fees are non-refundable once paid, regardless of cancellation.

- Payment must be made by the specified due date outlined in the acceptance communication.

3. Booth Assignment and Setup

- The Organizer will assign booth spaces to Vendors. Vendors may not transfer or share their assigned space without prior written approval from the Organizer.

- Vendors are responsible for their booth setup and must adhere to the designated setup and breakdown times.

4. Product and Service Guidelines

- Vendors must offer products or services that align with the theme of the fair.

- Vendors must display a complete list of ingredients for any samples or testers provided to attendees.

5. Liability and Insurance

- Vendors assume full responsibility for their products, services, and any consequences arising from their participation in the Event.

- Vendors are encouraged (not required) to carry their own liability insurance to cover any claims that may arise. The Organizer will not be held liable for any damages, losses, or injuries incurred during the Event.

6. Conduct and Engagement

- Vendors are expected to engage positively with attendees and create a welcoming atmosphere at their booths. High-pressure sales tactics are not permitted.

- Vendors must maintain professionalism and adhere to a family-friendly environment throughout the Event.

7. Cancellation and Transfers

- Vendors who decide to cancel their participation after payment of the vendor fee will not be entitled to a refund.

- Vendors may not transfer their paid spot to another vendor without prior approval from the Organizer.

8. Compliance with Laws

- Vendors must comply with all local, state, and federal laws and regulations related to their business, including health and safety regulations.

9. Event Changes and Cancellations

- The Organizer reserves the right to modify the Event schedule, location, or format as necessary. In the event of cancellation due to circumstances beyond the Organizer's control, the Vendor assumes the risk of loss and will not receive a refund.

10. Indemnification

- Vendors agree to indemnify and hold harmless the Organizer, its affiliates, and its personnel from any claims, damages, losses, or liabilities arising from their participation in the Event.

11. Permission to Use Information

The Vendor grants The Interactive Psychic/Magickal Minds Metaphysical Fair the right to use their name, business name, images, logos, and any other related content for promotional purposes. This includes, but is not limited to, publication on the event website, social media platforms, and other marketing materials. The Vendor understands that this information may be shared publicly and acknowledges that they have the authority to provide such consent.

12. Sales Tax

All vendors participating in the Event are required to comply with applicable local, state, and federal laws regarding sales tax. Vendors must collect and remit sales tax on all products and services sold at the event in accordance with the tax regulations of the county where the event is held.

It is the responsibility of each vendor to understand the tax obligations related to their business and to ensure that they are in compliance at all times. The Organizer will not be held liable for any vendor's failure to adhere to these tax requirements. Vendors are encouraged to consult with a tax professional if they have questions regarding their sales tax obligations. By participating in the Event, vendors acknowledge and agree to abide by this sales tax clause.

13. Sharing Space

Vendors are permitted to share their assigned booth space with another vendor only with prior written approval from the Organizer, The Interactive Psychic. Any requests to share space must be submitted in writing (on the application).

The Organizer reserves the right to approve or deny any request for shared space at its sole discretion. Vendors who do not obtain prior approval for sharing space may be subject to removal from the event.

14. Electric

The availability and provision of electrical services at the Event may vary depending on the venue and its specific accommodations. Vendors are advised that some venues may handle electrical documentation and payments independently, and the Organizer, The Interactive Psychic, may not be responsible for these arrangements.

If you require electrical services for your booth, please indicate this need clearly on your application. It is the vendor's responsibility to ensure that all necessary arrangements for electrical access are made in accordance with the venue's policies. Vendors who fail to note their electrical requirements may not have access to power during the Event. By participating in the Event, vendors acknowledge and agree to comply with this electric clause.

15. Contract

A contract will also be provided for your review. At the bottom of the contract, you will find a section titled “Entire Agreement,” which serves as an acknowledgment of all the stipulations outlined in the terms and conditions, as well as the details contained within the contract itself.

By submitting your application to participate as a vendor in the Magickal Minds Metaphysical Fair, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
